Memorandum of Agreement
Between
The National Association of Air Traffic Specialists
And the
Federal Aviation Administration
This memorandum of agreement between the National Association
of Air Traffic Specialists (NAATS) and the Federal Aviation Administration (the
Agency), jointly referred to as the Parties, constitutes the final and binding
agreement regarding the implementation of FAA Order 7210.56A. Within 30 days of
the date of this agreement, the agency agrees to place a copy of this MOA in the
Read and Initial (R&I) binder at all facilities where NAATS bargaining unit
members are employed.
1. Paragraph 3-1-2b. It is understood by the Parties that the alternate
procedures referred to may require negotiations at the local level unless
otherwise agreed upon by the Parties in accordance with article 9 of the
existing CBA.
2. Paragraph 4-1-3c. Example 2, for the purposes of interpretation, the Parties
agree that the word "adequate" in this context means in accordance with Agency
directives.
3. Paragraph 5-1-4a4(b). The intent of this paragraph is to ensure that the
employee is afforded a reasonable opportunity to participate in the
investigative process, except during the interview of other employees, as long
as he/she is available. This does not require the employer to delay the
investigation due to the unavailability of said employee. Employee participation
in the investigation shall be on duty time.
4. Paragraph 5-1-5b3. The preparation of the referenced written comments and
recommendation shall be on duty time if otherwise in a duty status.
