MEMORANDUM OF UNDERSTANDING
BETWEEN THE
FEDERAL AVIATION ADMINISTRATION (FAA)
AND THE
NATIONAL ASSOCIATION OF AIR TRAFFIC SPECIALISTS (NAATS)
This is the complete agreement and understanding of the
Parties concerning the FSS/AFSS Consolidation Placement Program (CPP) which
resulted from the June 15, 1994 NAATS/FAA agreement concerning the placement of
National Air Traffic Controllers Association (NATCA) bargaining unit
personnel into the NAATS bargaining unit. Within 30 days of the signing of this
MOU, the Employer agrees to place a copy of this MOU in the Read and Initial
(R&I) Binder at all facilities where NAATS bargaining unit members are located.
Section 1. STAFFING.
The Parties agree that the following issues are subject to negotiations at the
identified level:
Facility level:
Distribution of bargaining unit employees to satisfy
coverage requirements (e.g., shift coverage).
The impact on the facility bargaining unit resulting from
the assignment of bargaining unit personnel to non-unit positions (e.g.,
temporary details and temporary promotions).
Regional level:
Facility hours of operation in accordance with FAA Order
7232.11.
Staffing imbalances among facilities within the region to
ensure maximum use of resources. If an adjustment of staffing is agreed to
by the Parties, bargaining unit employees may request to be moved to resolve
the imbalance. Permanent Change of Station (PCS) funds are not guaranteed
for all such moves.
National level:
Distribution of bargaining unit employees among regions.
Section 2. CONSOLIDATION.
The Employer agrees that the existing FSS's listed in Attachment 1 to this MOU
will be consolidated in this fiscal year. The Employer agrees that the schedule
for these consolidations will be provided to the Union by December 31, 1994. If
the Employer cannot meet the scheduled dates for any consolidation, the Union
will be provided notification as soon as this fact is known to the Employer. The
Parties will negotiate the impact of the delay on bargaining unit employees. The
Parties further agree to continue negotiations regarding the NAATS bargaining
unit members employed at Flight Service Stations, other than those listed in
Attachment 1.
Section 3. NATCA UNIT PLACEMENT
The Parties agree to place one NAATS bargaining unit member, as identified by
the NAATS President, from an FSS into an AFSS for every placement of a NATCA
bargaining unit member into the Flight Service option. The NAATS Regional
Director and the FAA Air Traffic Division Manager in each region will reach
consensus on which FSS�s and AFSS�s will be affected by both the NATCA and NAATS
bargaining unit moves in their region, and the number of bargaining unit members
that may be released from, or assigned to, any one facility. The number of
ATCS's that can be placed in a particular AFSS shall be based on the
availability of meaningful training and meaningful work.
The Parties agree that the placement of NATCA bargaining unit members into the
NAATS bargaining unit shall not count against facility staffing in any way.
The Parties further agree to allow one IPP move for every placement of a NATCA
bargaining unit member into the FSS option. The NAATS President shall identify
these bargaining unit employees for relocation. Employees must have at least a
Fully Successful rating. Release dates shall be negotiated by the Parties at the
regional level and shall not normally exceed 6 months from the time of the
bargaining unit member identification by the NAATS President.
Criteria for employee designation in these MPP/IPP moves shall be developed by
NAATS consistent with statute and government-wide regulations.
The designated bargaining unit members must be identified within 120 days of the
NATCA bargaining unit members entering the NAATS bargaining unit. Each NAATS
ATCS placed in an AFSS through MPP in this agreement will receive a PCS order
within 2 pay periods of being identified, and will receive all related
entitlements. The Parties agree that IPP moves do not qualify for PCS.
Section 4. TRAINING FAILURES.
The Parties agree that prior to the placement of any training failures from any
other Air Traffic option into the NAATS bargaining unit, the appropriate
Division Manager shall contact the appropriate NAATS Regional Director. The
Parties at the regional level will then negotiate the locations /conditions
under which these training failures will be placed. An example of a condition to
be negotiated are IPP/MPP moves, as appropriate, for NAATS bargaining unit
members in return for the placement of these training failures. The Parties at
the regional level are free to discuss and explore any option. This paragraph
shall also apply to the placement of developmentals. These negotiations shall be
conducted in accordance with Article 9 of the NAATS/FAA Agreement.
Section 5. This is the complete understanding of the Parties. This
agreement will remain in force and effect until the renegotiation of the
national agreement.

Attached is a letter from the National Association Of Air Traffic Specialists
(NAATS) President, Mike McAnaw, listing his selections for the initial Internal
Placement Program (IPP) and for permanent change-of -station (PCS) moves in
accordance with the CPP Memorandum of Understanding (MOU) dated November 25,
1994. Please note that the reference to "MPP" (on the top of the second page of
the letter) is incorrect. The persons named on that page are to receive PCS
moves with Facilities and Equipment money under the consolidation program, but
are not identified for this list under the Merit Promotion Program process.
Based on information from the Level I Contract Tower program office, nine
persons have been selected for transfer to the flight service option under the
program to date. This means that NAATS is entitled to nine PCS moves from flight
service stations (FSS) to automated flight service stations (AFSS) and nine IPP
moves.
Actions required at the regional level are listed here:
Affected regions are to consider the impact of the moves
identified. Regions should look not only at the facility or region the
employee will be leaving, but also at the facility or region into which the
employee will be transferring. In those situations where a designated move
takes the employee across regional boundaries, the effected regions should
coordinate with one another before proceeding to the next step.
The Division Manager will then meet with their corresponding
NAATS Regional Director to discuss the designated moves, specifically:
Release dates for persons named on these lists. IPP
releases will not normally exceed 6 months from the time of employee
identification (Third paragraph of Section 3). Persons identified for a PCS
move will receive travel orders within two pay periods of being identified
(Fifth paragraph of Section 3). If the division manager feels that a person
cannot or should not be transferred either into or out of a facility or
region, they are to be prepared to discuss their reasons with their NAATS
counterpart.
Reasons why some persons cannot be released, if
applicable, and options for making the release possible. Managers and their
NAATS counterparts are encouraged to be creative in identifying ways that
these moves can be made, however, at no time are we to disregard regulations
and laws.
Which FSS's and AFSS's in the region will be affected by
the bargaining unit moves (First paragraph of Section 3 of the MOU);
Advise ATZ-20 of the results of the regional meeting when
agreement is reached.
As a word of clarification, the November MOU on CPP supersedes
the June MOU on the same subject. Therefore, the earlier MOU may be disregarded
in this and future work with the union.
