MEMORANDUM OF UNDERSTANDING This memorandum of understanding (MOU) is made and entered
into by and between the National Association of Air Traffic Specialists (the
Union or NAATS) and the U.S. Department of Transportation, Federal Aviation
Administration (FAA or the Agency). The purpose of this agreement is to create
an interim supplement to the FAA Performance Management System in FAA Order
3500.7, dated May 24, 1988. It applies only to the employees in the NAATS
bargaining unit. An employee's performance on each element will be rated at one of 3 levels: Exceeds the Standards, Fully Successful or Unacceptable. (This replaces the relevant portion of Paragraph 88e.) 2. SUMMARY RATING LEVELS A summary rating will be assigned at one of 3 levels: Exceeds the Standards, Fully Successful or Unacceptable. (This replaces the relevant portion of Paragraph 88e.) 3. RATING FORM The Annual Performance Rating Form (Attachment 1 to this supplement) will be used for the ratings of employees. (This replaces Appendix 2.) 4. RATING PERIOD This MOU will be effective December 1, 1994. The interim rating period will be from January 1, 1995 to March 31, 1995. A new rating period will begin April 1, 1995, and ends March 31, 1996. (This supplements Paragraph 83a.) 5. PERFORMANCE ELEMENTS AND STANDARDS a. For the interim appraisal cycle under this plan, performance elements and standards will be delivered to covered employees no later than December 31, 1994. b. The rating official and the employee shall sign and date the Certification of the Delivery of the Elements and Standards block on the Annual Performance Rating form. The rating official shall keep the original of the form and give the employee a copy. [This replaces Paragraph 81a (2).] 6. CERTIFICATION OF MID-APPRAISAL PERIOD PROGRESS REVIEW The employee and the rating official will sign and date the Certification of Mid-Appraisal Period Progress block on the Annual Performance Rating Form, to document that the midappraisal period progress review has taken place. The rating official should keep the original of the certified form and the employee should receive a copy. [This replaces Paragraph 81b(3).] 7. CALCULATION OF ELEMENT RATING LEVELS The first step in determining the summary rating is to rate the individual job elements. Each job element will be assigned one of-the three ratings defined below a. Exceeds the Standards (level 5) will be given a score of 2 points. b. Fully Successful (level 3) will be given a score of 1 point. c. Unacceptable (level 1) will be given a score of 0 points. (This replaces the relevant portion of Paragraph 88e.) 8. CALCULATION OF SUMMARY RATING LEVELS a. After each job element is rated, the rating for each element will be multiplied by the element's weight factor to determine that element's score. b. The scores of the elements will be added together to develop a summary rating. A total score of 2.00 - 1.60 will be Exceeds the Standards. A total score of 1.59 - 1.00 will be Fully Successful. A total score of 0.99 - 0.00 will be Unacceptable. One or more critical elements rated Unacceptable will result in a summary rating of Unacceptable. (This replaces Paragraphs 88f and g.) 9. CERTIFICATION OF ANNUAL RATING a. The rating official shall complete and sign the Certification of Annual Rating portion of the Annual Performance Rating form. The reviewing official shall sign the Certification of the Annual Rating portion of the form, indicating his or her approval of the rating and return it to the rating official for delivery to the employee. The employee will sign the form, indicating receipt of the form. [This replaces the relevant portions of Paragraph 81c(4).] b. The rating results shall not be released to the employee until completed ratings of record have been reviewed and approved by the reviewing official. Any disagreements with the appraisal by the reviewing official must be discussed with the rating official. The reviewing official may change the rating and must document the performance-based reason for the change and attach it to the appraisal. 10. BUDGET FOR THE PAYMENT OF PERFORMANCE AWARDS a. For the purposes of determining performance awards, all employees in the NAATS bargaining unit will be one unit. (This replaces Paragraphs 22 and 23.) b. In determining the performance award budget for employees in the NAATS bargaining unit, the provisions of FAA Order 3500.7, paragraph 40(b)(1) shall apply. 11. PAYMENT OF PERFORMANCE AWARDS a. To calculate performance awards, the number of shares for payment of performance awards will be determined by multiplying the number of employees with an Exceeds the Standards rating by 3 and adding to that number, the number of employees with a Fully Successful rating. b. The monetary value for each share will be established by dividing the performance awards budget for each unit by the number of shares which have been created by the process in 11a. c. An employee who has a rating of Exceeds the Standards will receive a performance award equal to the value of 3 shares. An employee who has a rating of Fully Successful will be given a performance award of the value of 1 share. (Section 11a and b above replace Paragraph 40a.) 12. PERSONNEL RECORDS For entry of the rating of record into the official personnel records of the employee, a rating of Exceeds the Standards (equivalent to Outstanding) will be given a value of 5; Fully Successful, 3; and Unacceptable 1. (This replaces the relevant portion of Paragraph 88e.) 13. QUALITY STEP INCREASES Only employees receiving a rating of "Exceeds the Standard" are eligible to receive a Quality Step Increase under the criteria outlined in paragraph 43 of FAA Order 3500.7. This agreement contains the entire understanding of the
parties. No modification or waiver of any of its terms of agreement shall be
valid unless it is made in writing and executed by the parties.
