MEMORANDUM OF AGREEMENT
The parties agree to the following terms
and conditions as full and complete resolution of any current and future Union
grievances at the national and local level concerning the application of Article
4, Section 4 -12(b). The Union agrees to withdraw any and all grievances or
other formal complaints concerning this issue effective the date of this
agreement.
Consistent with the provisions of Article 4, Regional Coordinators may request
approval of the respective Air Traffic Manager (ATM) to use their allotted
official time to perform representational duties away from their facility. It is
understood that approval of such requests is subject to operational
requirements. No additional official time is authorized beyond the amount
provided in Section 4-12(b) for any travel to and from the Regional
Coordinator's facility to perform such representational duties.
The Union also agrees to withdraw its grievance on dues withholding (NA)
ALR-94-1-NAT-6 as of the effective date of this agreement. The Parties will
develop mutually agreed upon administrative procedures to insure that the
requirements of Article 8, Section 5 when processing SF-1188's are complied with
by all Parties (i.e.; the union, agency, and employees). It is understood that
any administrative procedures developed by the Parties cannot violate an
employee's right under 5 USC 7115 or be inconsistent with the Parties'
agreement.
This settlement agreement contains the entire understanding of the Parties. No
modification or waiver of any of its terms shall be valid unless it is made in
writing and executed by the national Parties.
This agreement is effective August 30, 1994.
