MEMORANDUM OF
UNDERSTANDING
This Memorandum of Understanding
satisfies the bargaining obligation between the National Association of Air
Traffic Specialists and the Federal Aviation Administration concerning the
Federal Employees Pay Comparability Act of 1990.
Section 1. The agency agrees to advise the union when and for what reason, a
relocation bonus, retention allowance or staffing differential is offered to a
bargaining unit employee who will encumber a bargaining unit position.
Section 2. Should the agency develop a program to provide compensation
above the minimum entry rate for any bargaining unit position, the union shall
be notified in advance.
Section 3. If the agency determines that a personal employment interview
is necessary for a bargaining unit employee, travel expenses will be paid by the
agency in accordance with 41 CFR 301-1.
Section 4. The agency will notify the union when a bargaining unit
employee is offered a waiver of dual compensation to encumber a bargaining unit
position. Such notice will contain the bargaining unit members name, current
duty station and if applicable, new duty station.
Section 5. The agency agrees to notify the union of any proposed special
salary rates for bargaining unit positions.
Section 6. All time off from duty awards shall be scheduled and used in
accordance with 5 USC 4502 and implementing OPM regulations. The agency shall
provide the union with any national criteria that the agency develops for
granting time off awards. If in management's opinion, either a time off from
duty award or a monetary award is appropriate, employee preference should be
considered. Management retains the right to select and determine awards.
Section 7. Hours in a paid, non-work status, e.g. annual leave and sick
leave, are counted as hours worked for the purpose of determining an employee's
entitlement to overtime. Compensatory time in lieu of paid overtime is granted
at the rate of one hour of compensatory time for each hour of overtime worked.
Section 8. If the Agency establishes a study team to review any air
traffic positions for consideration of special occupational pay systems that may
affect bargaining unit members, the union headquarters will appoint a
representative to the study team.
Section 9. The union retains all statutory rights, including negotiating
over conditions of employment, with respect to the matters addressed in this
agreement.
