Thank you for your recent letter dated April 27, 2004 discussing the role of "Right of First Refusal" in OMB Circular A-76 public-private competitions. Your concern regarding private sector vendors and their understanding of how the Government implements this clause is understandable. The Automated Flight Service Station (AFSS) Screening Information Request (SIR) includes Acquisition Management Clause 3.2.1.3-2, entitled "Right of First Refusal of Employment (September 2003)". The Federal Aviation Administration intends to strictly and appropriately implement this clause and all other provisions of this solicitation.

We fully concur that an appropriate interpretation of your concern is necessary in order for employees to have the tools necessary to make future decisions. This is a complex issue and requires a comprehensive response. We, therefore, appreciate your patience in permitting us to conduct the appropriate research. We will get back to you a timely manner when we have a more definitive answer.

Again, I thank you for your input as we continue to pursue the AFSS competitive sourcing process. The integrity of the competitive sourcing process relies on the active involvement of all interested parties. Therefore, I strongly encourage your continued participation on the AFSS study.
